FAMILY LAW MEDIATION
Separation is an uncertain time where emotions run high and big decisions often need to be made quickly. Our highly skilled accredited family dispute resolution practitioner and mediator will provide you with an efficient, cost-effective alternative to court proceedings and provide a safe, reliable and confidential service to assist you to make important decisions about your matter including children and property, spousal maintenance and child support.
- Mediation will take place in a safe and confidential setting with a minimum of formality
- The agenda will be tailored to ensure the mediation is outcome focused
- Our mediator is committed;
- To working with you to explore options for dispute resolution, not just exchange offers and be a mouthpiece;
- to understand the nature of the dispute by engaging with each of the parties.
- To facilitate a process which allows you to direct the conversation; and
- work with you, either you have legal representation or not.
WHEN TO MEDIATE
- before filing proceedings, in family law matters
- at any time with or without a lawyer; or
- if directed to do so by a Court
Our Process
- Our mediator will meet with each party separately, prior to mediation and conduct a preliminary assessment conference to discuss your situation and concerns.
- The mediation will be tailored to suit each of your needs and reduce your anxiety and concerns about the day, particularly where you are worried about conflict. The mediation can be face to face or in separate rooms, or remotely by phone, Skype or by Microsoft Teams.
- You will be invited to tell your side of the story and prepare a mediation statement, setting out a summary of the dispute and your proposals for resolution. You may provide any court documents, expert evidence and any other important material relevant to the dispute.
- Our mediator will thoroughly prepare by reading the material in advance of the mediation.
- You will be assisted to formulate and exchange proposals for settlement.
- In parenting matters, you might like to consider having a child consultant to assist you in decision-making.
- In financial matters, you may seek the advice of your accountant or financial advisor to help make some decisions.
- You’re welcome at any time to seek the advice or support of a lawyer if you were unrepresented at the mediation.

Our mediator will assist you to document your agreement reached at mediation and if no agreement is reached, provide you with a S60I certificate.
CHILD INCLUSIVE MEDIATION
Where children have sufficient maturity or level of understanding to be involved in the mediation process, their views can be taken into account with the approval of both parents. A child expert will meet with the parents and children separately and facilitate sharing the children’s views, wishes and recommendations to help reach a child focused agreement.
Mediation Fees
Mediation is only a fraction of the usual cost of litigating in Court.
A fixed fee will be charged for the initial preliminary assessment conference.
Fees can be tailored are to suit your individual circumstances.
Half Day Mediation – 4 hours @$2,420.00 (inclusive of GST)
Full-Day Mediation – 8 hours $3,630 (inclusive of GST)
Civil and Commercial Mediation
Commercial disputes between parties resulting enormous drain on time, energy and money, particularly in commercial matters as this is very disruptive to your business and your personal life.
Mediation is a great alternative and can be cost-effective and quicker path to resolution and litigation stop mediation. Also gives you control over the outcome rather than the risk of a Court getting it wrong.
The mediation process
- Once appointed, and prior to mediation, Kathleen will meet with each party on a confidential basis to discuss the situation, explore goals for resolution and best approaches;
- Coordinate the logistics of the mediation (date, time and whether online, face-to-face or shuttle);
- Conduct the mediation with both parties;
- Engage with supporters of decision-makers including advisors (legal, financial or other);
- Co-mediation services are also available and well suited to multipart disputes.
